LANSING – State Representative Fred Miller (D-Mount Clemens) today applauded Governor Jennifer M. Granholm for signing a package of bills that will strengthen protections for consumers who purchase gift certificates. The plan, which was signed into law on Thursday, will ensure consumers are getting the most out of their hard-earned dollars.
"It can be challenging deciding what to buy for your loved ones on special occasions, and gift cards and gift certificates are a great option for Michigan consumers," said Miller, a lead sponsor of the package. "However, some retailers are engaging in deceptive practices by hiding service or activity fees, and are shortchanging customers. By enacting this plan, Michigan consumers can feel confident they are getting what they pay for."
Miller's plan will require retailers to disclose all terms and conditions to a prospective purchaser. The plan will also prohibit selling a gift certificate to a consumer that has an expiration date of less than five years after the purchase, and will prohibit retailers from charging inactivity fees or service fees on gift cards or certificates.
The plan gained final approval from the Legislature on June 27.
"It's easy to miss hidden service or activation fees, or forget expiration dates that come along with gift cards," Miller said. "Consumers who are spending money during these challenging economic times shouldn't be punished for that. I'm very pleased that we were able to work together and do the right thing for our consumers by adding these simple protections."
